Employment “Consulting”

Haskin and Associates offers clients hourly rate legal consulting. Caught “Red Handed”?

Haskin and Associates recently defended a client allegedly caught “red-handed” using an illegal substance.

When illegal drugs were found in the automobile and our client was observed holding an object that appeared to contain that same substance, it appeared to many, including the prosecutors, that he had been caught “red-handed.” However, careful review of the evidence revealed the weaknesses in the state’s case. After Haskin alerted the prosecution to the errors, the charges were reduced to a misdemeanor and the client was released.

Employment Claim Settles

Haskin and Associates settles another employment claim. After suffering from a serious illness, the client brought suit for violations of the Family Medical Leave Act. Her termination became effective the day after she returned to work. The fact that she was the number one performer on the team prior to her leave left her confused about the termination. After hiring Haskin and Associates, a number of clear violations of myriad Federal Laws became apparent. A charge with the EEOC and subsequent mediation resulted in a very favorable settlement agreement to the client. To protect her identity and that of her former employer, the terms of the settlement are confidential.

FMLA CLAIMS

The Family and Medical Leave Act (FMLA)…

  • Ensures eligible employees are able to use up to 12 weeks of unpaid leave. Qualifying leave can be used all at once or in increments as short as a few hours at a time.
  • Ensures eligible employees maintain insurance benefits.
  • Ensures eligible employee who returns to work will be given his or her previous position or an equivalent job with the same salary, benefits and other conditions of employment.

To qualify for FMLA, an employee must have worked for his or her employer for at least 12 months, including at least 1,250 hours during the most recent 12 months. The law applies to workers at all government agencies as well as private companies with 50 or more employees within 75 miles.

Former Georgia State Student Bar President Working with Haskin and Associates

The former Georgia State University Student Bar President, David Purvis has associated with the Atlanta Law firm Haskin and Associates, LLC. The firm is located in Atlanta and handles myriad types of cases including domestic issues, personal injury, employment problems and criminal matters. Purvis, who worked as a Law Clerk prior to passing the bar, is developing skills in Civil Litigation. As a new attorney, Purvis is developing skills in litigation including drafting complaints and navigating discovery in various types of litigation.

Mr. Purvis finished law school in the spring of 2010. He spent the summer working part-time with Haskin and studying for the July Bar Exam. Results were posted at the end of October and Purvis received the good news that day. Purvis was formerly a Manager at Guitar Center but has always been interested in practicing law. Like so many graduates of Georgia Law Schools, Purvis was relieved to finally get his results so he can begin working in his chosen field.

Haskin commented that: “I am ecstatic for Dave and know he is going to be a great lawyer. He has worked with me for a couple years as a law clerk and I am looking forward to working with him as a colleague. Dave is going to be a welcome addition to the Georgia State Bar Association.”

Haskin and Associates shifts business to in-town “warehouse” location to better serve customers

In an effort to serve clients throughout metro-Atlanta, The law offices of Haskin and Associates have moved its location. Now, the law firm is located just outside of Atlantic Station, in Atlanta’s West End. The new space is “comfortable and fits our personality,” said Haskin. “It is also important that the new office will accommodate growth when we need it,” Haskin said.

Recent graduate of Georgia State University Law School, Dave Purvis who does work for the firm, commented that he feels “motivated and energized” in the new space. He likes being located in the West End of Atlanta due to all of the new development and he thinks that clients will enjoy the easy access to the new downtown location.

The office is not your typical law office. It affords those seeking assistance a comfortable and laid-back atmosphere that will invariably ease the tension often associated with legal problems. Haskin says he will still meet potential clients wherever it is convenient but is happy to provide a relaxed atmosphere to his potential clients.

Arguing Gender Bias of DUI Test Wins Case

Lisa Bufton of Woodstock was acquitted in a DUI case last month.

Two glasses of merlot put a Cherokee County woman in the middle of a dispute over how to accurately measure whether females are legally intoxicated.

The jury in Lisa Bufton’s drunken driving case acquitted her last month after her attorney argued the breath analysis instrument used by Georgia law enforcement personnel gives falsely high readings when used on women. The Cherokee County jurors said the Intoxilyzer 5000 should be “further evaluated for gender bias.”

Bufton’s lawyer, Atlanta attorney Billy Spruell, said the Intoxilyzer 5000 is calibrated to men’s physiology and the way men’s bodies metabolize alcohol. Women metabolize alcohol in a different way, he argued.

But the machine’s manufacturer says the instrument’s readings for women are accurate.
